Terms of Service

1. Scope
These terms govern the use of pitchevent.studio (the "Service"), operated by bost& UG (haftungsbeschränkt), Jülicher Straße 72a, 52070 Aachen, Germany ("we", "us"). You are entering into a contract with bost& UG (haftungsbeschränkt) for the use of the Service. By creating an account or continuing to use the Service you agree to these terms. The Service is offered to businesses, organizations and self-employed professionals only. It is not offered to consumers.
2. The Service
pitchevent.studio is a web application for running pitch events: agenda management, slide and video playback, an audience screen, timers, a question room, audience voting and a moderator view. We provide the Service as software-as-a-service and may improve or change features as long as the core purpose remains.
3. Account
- You need an account to use the Service and are responsible for your credentials.
- You are responsible for everything that happens under your account, including access you grant to moderators.
- Accounts are for one organization; sharing across organizations is not permitted.
4. Price, billing and term
- The Service is offered in three plans, billed annually, excluding VAT. They differ only in the number of guests included per plan year; all features are included in every plan:
- Basic — 1.000 guests per year for 480 € per year.
- Premium — 2.000 guests per year for 720 € per year.
- Premium Plus — 5.000 guests per year for 1.200 € per year.
- Larger volumes are covered by an Enterprise agreement with individually agreed guest numbers, terms and support, available on request.
- One guest is one device that opens your question room or voting room, counted once per event. Reloads, upvotes and switching between the question and voting room never count twice. Your director desk, audience screen and moderator view never count.
- Guests are counted per plan year. Your rooms keep working up to 120% of the included guest number. Above that, devices that already joined an event keep access, while new devices are shown a "room full" notice until the account is upgraded to a larger plan.
- Additional guests are obtained by upgrading to a larger plan. Guest packs are not sold separately, and unused guests do not carry over into the next plan year.
- There is no free trial and no monthly billing option. Access to the Service requires an active paid subscription.
- The subscription term is 12 months and renews automatically for another 12 months unless cancelled at least 30 days before the end of the current term.
- Payment is due in advance for the full term. Invoices are issued electronically to the billing email in your organization settings.
- If payment fails or is not made, we may suspend access after notice until payment is received.
5. Reseller, payment processing and taxes
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation and refund mechanics are therefore also governed by Paddle's Buyer Terms. Prices exclude VAT; applicable VAT or sales tax is added by Paddle at checkout.
6. Cancellation and refunds
You can cancel at any time so that your subscription is not renewed; cancellation takes effect at the end of the current term. We offer a 14-day money-back guarantee: you can request a full refund within 14 days of your order date. Refunds are processed by Paddle — request one at paddle.net or contact us. 7. Acceptable use
- Do not upload content you have no rights to, or content that is unlawful, defamatory or infringing.
- Do not attempt to circumvent access limits, storage quotas or the paywall, and do not probe or attack the Service.
- You are responsible for moderating audience-submitted questions and reactions shown on your screens.
8. Your content
You keep all rights to the decks, videos, images and event data you upload. You grant us the limited right to store and process this content to operate the Service. We delete your content within 30 days after your account is closed, unless we must keep it longer by law.
9. Availability
We aim for high availability but do not promise uninterrupted operation. Maintenance is announced where practical. Because pitch events are live, we recommend keeping a copy of your decks locally as a fallback.
10. Liability
We are liable without limitation for intent and gross negligence, and for damages from injury to life, body or health. For slight negligence we are liable only for breach of a material contractual obligation, limited to the foreseeable damage typical for this type of contract, and capped at the fees paid in the 12 months before the event causing the damage. Liability for lost profits and indirect damages is excluded.
11. Changes to these terms
We may update these terms with at least 30 days' notice by email. If you do not agree, you may cancel with effect from the date the change takes effect.
12. Governing law and venue
German law applies. Exclusive place of jurisdiction is Aachen, Germany, to the extent legally permissible.
